Welcome to Feeksee ("Feeksee," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of Feeksee's website, applications, platforms, products, and services.

By accessing, using, or purchasing any Feeksee services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. About Feeksee

Feeksee is a technology and digital transformation service provider offering services including, but not limited to:

• Website and application development;
• Artificial Intelligence (AI) implementation and integration;
• Business process automation;
• Digital marketing;
• Search Engine Optimization (SEO);
• Social media management;
• Digital content creation;
• Technology and digital transformation consulting;
• Other services made available from time to time.

2. User Eligibility and Requirements

By using Feeksee’s services, you represent and warrant that:

• You are at least 18 years old or otherwise possess the legal authority to enter into binding agreements;
• You provide accurate, complete, and up-to-date information;
• You have the right to use and submit any data provided to Feeksee;
• You will not use the services for any unlawful purpose.

If you use the services on behalf of a company or organization, you represent and warrant that you have the authority to bind such entity to these Terms.

3. Scope of Services

Feeksee may provide services under:

• Published service packages;
• Business proposals;
• Project contracts;
• Service Agreements;
• Monthly subscriptions or recurring service plans.

The detailed scope of work, deliverables, timelines, objectives, and fees may be governed by separate agreements, proposals, or contracts where applicable.

4. Accounts and Security

Where account registration is required, users are responsible for:

• Maintaining the confidentiality of account credentials;
• Securing devices used to access the services;
• Promptly notifying Feeksee of any unauthorized access or security breach.

Users are solely responsible for all activities conducted through their accounts.

5. Prohibited Uses

Users may not use the services for:

• Any unlawful activity;
• Fraud, phishing, or malware distribution;
• Spam or unauthorized mass communications;
• Intellectual property infringement;
• Distribution of content involving hate speech, discrimination, illegal pornography, illegal gambling, or other prohibited activities;
• Activities that disrupt the stability, integrity, or security of Feeksee systems.

Feeksee reserves the right to refuse, suspend, or terminate services in the event of violations.

6. Intellectual Property Rights

All intellectual property rights associated with:

• The Feeksee name;
• Logos;
• Designs;
• Systems;
• Platforms;
• Documentation;
• Marketing materials;
• Technologies developed by Feeksee;

are owned by Feeksee or its licensors.

No material may be copied, reproduced, distributed, modified, or used without prior written consent.

7. Ownership of Work Product

Unless otherwise specified in a written agreement:

Upon full payment, the client receives the agreed rights to use the delivered work product.

Feeksee retains ownership of:

• Internal frameworks;
• Internal templates;
• Libraries;
• Generic automation systems;
• Methodologies;
• Supporting technologies utilized in project delivery.

8. User Content and Data

Users retain ownership of all data and content submitted to Feeksee.

Users represent and warrant that:

• Such data is lawfully obtained and used;
• It does not infringe the rights of any third party;
• It complies with applicable laws and regulations.

Feeksee shall not be liable for any infringement or legal issues arising from materials provided by users.

9. Use of Artificial Intelligence (AI)

Certain Feeksee services utilize Artificial Intelligence (AI), Machine Learning, Large Language Models (LLMs), and other automation technologies.

Users acknowledge and agree that:

• AI-generated outputs may contain inaccuracies;
• AI-generated outputs may not be unique or exclusive;
• Human review and verification are required before relying on AI-generated outputs for important decisions;
• Feeksee does not guarantee the complete accuracy of AI-generated results.

Users assume full responsibility for any use of AI-generated outputs in connection with:

• Legal decisions;
• Medical decisions;
• Financial decisions;
• Regulatory compliance;
• Strategic business activities.

10. Personal Data Protection

Feeksee is committed to complying with applicable personal data protection laws in Indonesia, including Law No. 27 of 2022 regarding Personal Data Protection.

Personal data may be processed for purposes including:

• Service delivery;
• Customer support;
• Billing and payment processing;
• Service analytics;
• System security;
• Legal and regulatory compliance.

11. Payments and Refunds

Payments

Clients must make payments in accordance with:

• Issued invoices;
• Proposals;
• Contracts;
• Selected service packages.

Late Payments

Feeksee reserves the right to:

• Delay project work;
• Suspend services;
• Restrict access until payment is received.

Refunds

Unless required by law or otherwise agreed in writing:

• Payments already made are non-refundable;
• Fees for services already rendered are considered earned and non-refundable.

12. Service Availability

Feeksee will make commercially reasonable efforts to maintain service availability.

However, Feeksee does not guarantee that services will always be:

• Uninterrupted;
• Error-free;
• Free from downtime;
• Free from failures caused by third-party providers.

System maintenance may be performed at any time.

13. Third-Party Services and Platforms

Feeksee services may integrate with third-party platforms, including but not limited to:

• Google;
• Meta;
• TikTok;
• OpenAI;
• Anthropic;
• Cloudflare;
• Amazon Web Services (AWS);
• Microsoft;
• Other service providers.

Feeksee is not responsible for policy changes, service interruptions, service termination, or losses resulting from third-party providers.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Feeksee shall not be liable for:

• Loss of profits;
• Loss of business opportunities;
• Loss of data;
• Operational disruptions;
• Indirect, incidental, special, or consequential damages;
• Damages arising from the use of AI-generated outputs.

Under no circumstances shall Feeksee’s total liability exceed the total amount paid by the client to Feeksee during the twelve (12) months preceding the event giving rise to the claim.

15. Indemnification

Users agree to defend, indemnify, and hold harmless Feeksee, its affiliates, officers, employees, and partners from any claims, losses, damages, liabilities, costs, or expenses arising from:

• Violation of these Terms;
• Violation of applicable laws;
• Infringement of third-party rights;
• Misuse of the services.

16. Termination

Feeksee may suspend or terminate user access if:

• These Terms are violated;
• Security risks arise;
• Services are misused;
• Required by law, regulation, or governmental authority.

Termination shall not relieve users of any outstanding payment obligations.

17. Changes to These Terms

Feeksee may update these Terms at any time.

The latest version will be published on Feeksee’s official website and shall become effective upon publication.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia.

Any dispute arising out of or relating to these Terms shall first be resolved through good-faith negotiations. If no resolution is reached, the dispute shall be submitted to the competent courts of Indonesia.
